Terms of Service
These Terms of Service ("Terms") govern your use of the Who's Up mobile application ("the app", "we", "us"). By creating an account or using the app, you agree to these Terms. If you don't agree, please don't use the app.
1. Who can use Who's Up
You must be at least 13 years old to use Who's Up. By using the app you confirm that you meet this requirement and that the information you provide (including your phone number) is accurate and belongs to you.
2. What the app does
Who's Up lets you signal to your approved friends that you're available, and see when they're available. It is designed for connecting with friends you already have. It is not a dating service, a tool for meeting strangers, or a public social network.
3. Your account
You sign in with your phone number via a one-time passcode. You are responsible for activity that happens under your account and for keeping access to your phone number secure. Let us know promptly if you believe your account has been compromised.
4. Acceptable use
You agree not to:
- Use the app to harass, threaten, abuse, or harm anyone.
- Use the app to contact, groom, or exploit a minor, or to share illegal content of any kind.
- Add people as friends without a genuine prior relationship, or send unwanted invites at scale.
- Attempt to access accounts, data, or systems you're not authorized to access, or interfere with the app's operation.
- Impersonate another person or misrepresent your identity.
We may suspend or remove accounts that violate these rules. See our Child Safety Standards for how we handle child-safety violations.
5. Privacy
Your use of the app is also governed by our Privacy Policy, which explains what we collect, why, and how long we keep it. We do not sell your data, run ads, or track you across other apps.
6. Deleting your account
You can delete your account and associated data at any time from Settings → Danger zone → Delete my account in the app, or by emailing us. See Delete your account for details.
7. The app is provided "as is"
We work hard to keep Who's Up reliable, but the app is provided on an "as is" and "as available" basis without warranties of any kind. We don't guarantee that notifications will always be delivered, that the app will be uninterrupted or error-free, or that it will meet every expectation.
8. Limitation of liability
To the maximum extent permitted by law, Who's Up and its operators will not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid us, if any, in the 12 months before the claim.
9. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll note them on this page and, where appropriate, in the app. Continuing to use the app after changes take effect means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules.
